The information referred to in these Conditions and the details contained in this website are not an offer to the public, but a mere invitation to make a contractual proposal. If your offer is not accepted and a debit has already been made to your account, the amount will be returned to you entirely.
To place an order, you have to follow the online purchase procedure and click on “Close the Order” and “Cash” to proceed with the payment. Subsequently, you will receive an e-mail confirming the receipt of your order (the “Order Confirmation”). It is understood that this will not lead to the acceptance of your order as it constitutes an offer that you make us for the purchase of one or more products. All orders will be subjected to our approval which will be notified by sending an additional e-mail in case of changes or modifications.
The products offered in this website are available for delivery in almost every country in the world. Vertigo srl – dott.solari cosmetics reserves the right to evaluate the shipment once received the “Order Confirmation” email. For information, send an e-mail to firstname.lastname@example.org or fill out the contact form. Since the access and the possibility to send orders online, change the availability of the product in real time, Vertigo srl – dott.solari cosmetics does not guarantee the certainty of shipping the goods ordered in the usual times. Any unavailability will be promptly communicated.
Orders are accepted only and exclusively online or by telephone. The customer who sends the order online will receive, at the end of the procedure, a communication of order confirmation, by e-mail, with an order number; if after sending the order, the order number does not appear (after a few minutes), the proposal will be considered as not accepted, for all legal purposes, even if for accounting, administrative or product shortage reasons.
7.REFUSAL OF PROCESSING AN ORDER
We reserve the right to remove any product from this website at any time and / or to delete or modify any material or content of the same. Although we will always do our best to follow up all orders, there may be exceptional circumstances that force us to refuse to process orders after sending the Order Confirmation, and we reserve the right to do so at any time.
We decline any responsibility towards you or towards third parties for the removal of any product from this website, for the elimination or modification of any material or content of the website, or for the failure to process the order after sending the Order Confirmation.
The information about the products provided on the site is constantly updated. However, the complete absence of errors cannot be guaranteed. We reserve the right to correct errors, inaccuracies or omissions, images even after an order has been sent and also to change or update information at any time without prior notice. Images are used for illustrative purposes only, the product title will be authentic.
8.ORDER MODIFICATIONS AND CANCELLATION REQUESTS
We remind you that we are very quick to process orders (processing in 1 day) and that we use express couriers, this means that we cannot make changes once the order has been sent (change in delivery address, payment conditions, purchased products etc…).
You have only 30 minutes from the moment you confirmed and sent the order to inform us of any change to be made.
The order can be canceled if, at the time of the cancellation request, it is still being processing; in this case no cost will be charged to the customer. It is advisable to contact the customer service by telephone, for immediate confirmation.
If at the time of the request for cancellation of the order, the same has already been given to the courier, the Customer can exercise the right of withdrawal and send goods back at his own expense.
9.PRICES AND PAYMENT
All prices on the site are including VAT. Prices can be changed at any time, without notice.
The goods supplied must be paid with Credit Cards, Debit Cards, Paypal.

In Italy, shipping is free for orders over € 39.00.
Subject to the availability of the products and except where extraordinary circumstances occur, we undertake to do everything in our faculty to send the order of the product(s) indicated in the Order Confirmation by the scheduled date or, if no delivery date was specified, within the deadline estimated at the time of choice of the delivery terms and, in any case, within a maximum period of 30 days from the date of the Order Confirmation. However, delays may occur for several reasons such as the occurrence of unforeseen circumstances or the delivery area. If for any reason we are unable to comply with the delivery terms, we will inform you and give you the option to change the order by setting a new delivery date. Please note that no home deliveries are made on Saturdays and Sundays. For the purposes of these Conditions, the delivery will be deemed to have taken place, or the order delivered, through the acquisition by you or a third party, indicated by you, of the material availability or in any case the inspection of the products, which will be proven by the signature of taking charge of the package by the driver of the courier.
12.IMPOSSIBILITY OF DELIVERY
If it is not possible for us to carry out the delivery of your order, your order will be sent to the warehouse of our trusted courier where it will remain for 5 days. In this case, they will contact you / leave you a notice in which they will specify the place where you find your order and how to arrange a new delivery. If you are unable to be present at the place of delivery at the agreed time, we ask you to contact the courier again to arrange a new delivery date. If delivery cannot take place for reasons not attributable to us after 15 days from the date on which your order has been available for delivery, we will assume that you intend to terminate the Contract: this contract will therefore be considered terminated pursuant to art. 1456 cc, with simple communication that we will send by e-mail and, therefore, the order will be canceled for all intents and purposes. Within 15 days of the above mentioned communication, we will reimburse the total amount paid for the product(s), minus the costs of the unsuccessful shipment, the costs of returning the products and any other expenses we have incurred due to non-delivery caused by the absence or inactivity of the customer in receiving the delivery.
13.RESPONSIBILITY AND EXEMPTION FROM RESPONSIBILITY
Unless otherwise provided for in these Terms, our responsibility for the products purchased on our website will be limited exclusively to the purchase price of the product. We will not accept any responsibility for indirect damages, such as: i. loss of profits; ii. loss of turnover; iii. loss of earnings or loss of contracts; iv. loss of expected savings; v. data loss; as well as vi. waste of office administration time. Due to the open nature of this website and the possibility of errors in the storage and transmission of digital information, we do not guarantee the accuracy and security of the information transmitted or obtained through this website, unless the contrary is expressly stated. All descriptions of the products, information and materials that appear on the website are provided “as is” and without explicit or implicit guarantees,subject to the provisions of law. In this sense, if you are contracting as a consumer or user, we are committed to delivering products that comply with the Contract, remaining responsible for the lack of conformity existing at the time of delivery. It is understood that the products comply with the Contract if (i) they comply with the description we provide and they have the qualities shown on this website, (ii) they are suitable for the use for which the products are normally intended, (iii) show quality and features that are common in products of the same type and that can reasonably be expected. Within the limits set by the law, we exclude all guarantees, except those that cannot be legitimately excluded with regard to consumers and users.
At the time of delivery of the goods, the customer must verify the integrity of the packages and the quantity and quality in correspondence with what is indicated in the delivery document. In case of discrepancy, the same must be reported on the delivery document and confirmed, within seven days by e-mail or registered return letter, to Vertigo srl – dott.solari cosmetics. Although the packaging is intact, the goods must be checked within seven days from receipt. Any hidden defects must be reported in writing by e-mail or registered return letter. Any report beyond the above mentioned terms will not be taken into consideration. For each declaration, the customer takes full responsibility for what is declared.
14.RETURNS AND REFUNDS
The goal of Vertigo srl – dott.solari cosmetics is always to guarantee complete customer satisfaction for every purchase made.
Pursuant to Article 52 of Legislative Decree 206/2005 (Consumer Code), the Customer has the right to withdraw from the contract, without specifying the reason, by returning the Products purchased on the Web Site within 14 (fourteen) calendar days from the date of receipt of the order.
Once Vertigo srl – dott.solari cosmetics will receive the goods and check the perfect integrity of the same, the above mentioned company will arrange for a refund no later than 30 days.
To exercise the right of withdrawal, the Customer must send an email to the following address within 14 days from the date of receipt of the products: email@example.com a communication containing:
- indication of the Products for which the Customer wishes to exercise the right of withdrawal;
- the order number subject to refund;
It is not possible to exercise the right of withdrawal for products that have been opened after delivery.
Therefore, the returned products must be properly packaged in their original packaging, in perfect condition for sale (not damaged or dirty) and fitted with all accessories, instructions for use and documentation;they must not be opened or used and without signs of use. That is, they must not bear traces of any type of use and must not be in a state that does not allow their resale.
Once Vertigo srl – dott.solari cosmetics receives the goods and check the perfect integrity of the same, the above mentioned company will arrange for a refund no later than 30 days.
For the return and shipment of the product the customer is free to use a courier of his choice, of which he will bear the costs.
The customer must make this shipment within fourteen working days from the date on which he sent the notice of exercise of the right of withdrawal, and send the goods to:

The transport costs for the return of the products and the responsibility of the goods, for damages, theft and loss during the shipment, as provided by the law, are charged to the Customer.
In case of transport damage occurring during the return, Vertigo srl – dott.solari cosmetics will notify the customer within five working days of receipt of the product, allowing the costumer to file a complaint to the courier used for the transport.
The damaged goods will be made available for return and the withdrawal request will be canceled at the same time.
In case of an error in the order or shipment, it is possible to request a change or refund within 14 days from the date of receipt of the goods.
If the product received does not conform to the one ordered, it is possible to request a free change with the desired product, or another of the same amount.
The product sent incorrectly will be picked up by the courier in charge and charged Vertigo srl – dott.solari cosmetics .
The customer will have to make a request by e-mail to firstname.lastname@example.org, set up the product to be returned with a package, intact and well packed, and indicate:
- the place of collection of the products to be returned;
- date and time slot (at least 3 hours) of collection.
Please note that the collection can only be scheduled once. In case of unsuccessful collection, the shipment for the return of the goods will be charged to the Customer.
If the product received is damaged or defective (eg broken bottle and spilled product), you can request a new free shipping of the same product, or another of the same amount.
Photographic evidence of damage will be required for insurance purposes. Partial refunds or discount vouchers may also be offered.
In case of refusal at the time of delivery for an order processed correctly and already paid, the refund will be deducted from the round-trip shipping costs.
Vertigo srl – dott.solari cosmetics does not grant refunds or replacements for products that have caused an allergic reaction. If the customer experiences an allergic reaction from the use of the product, we advice to immediately stop using it. Vertigo srl – dott.solari cosmetics is not responsible for allergic reactions caused by the products as the customer should be aware of the products or ingredients to which he is allergic.

17.RIGHT OF MODIFICATION OF THESE TERMS
The use of our website and the purchase contracts for products on this website are governed by Italian law. Any disputes arising out of or relating to the use of the website or to such contracts will be subjected to the Italian courts. If you are stipulating the Contract as a consumer, this clause does not affect in any way the rights that the law recognizes as a consumer.
